U.K. Label Claims EXPERIENCE HENDRIX's Attorney 'Perjured Himself'

U.K. indie label Purple Haze Records has issued a statement defending itself against accusations by the Seattle-based Experience Hendrix that Purple Haze is marketing and selling unauthorized Jimi Hendrix recordings.

Experience Hendrix filed a second suit on Monday (Sept. 12) to stop the marketing and sales of all "unauthorized" Jimi Hendrix recordings through Purple Haze, according to Billboard.com.

In February, the High Court of Justice in London held Purple Haze and proprietor Lawrence Miller liable for infringing the rights of Experience Hendrix in recordings of the JIMI HENDRIX EXPERIENCE's 1969 Konserthuset performance in Stockholm.

Experience Hendrix, which is owned by members of the family of the late performer, owns and administers the rights to Hendrix recordings, songs and related properties.

The following is Purple Haze Records' official response to the latest lawsuit:

"1: Experience Hendrix LLC was not able to show any evidence to the court in support of their claim for the performance rights.

"2: Patrick John Gardiner, the UK Lawyer for Experience Hendrix LLC, perjured himself in court where he swore under oath 'Furthermore I am informed by Mr Wasson (the in-house Attorney for Experience Hendrix) and believe that the infringing discs made and issued by Purple Haze Records Ltd were live recordings made by SVT, a Swedish Company.' SVT is a Swedish Television Company.

"3: This statement is a blatant lie showing Patrick John Gardiner has lied and falsely misled the court in the effort to pervert the course of justice.

"4: Purple Haze Records Ltd released HAZE003 in February 2004

"5: SVT Swedish Television only found their film footage in September 2004, 7 months later and after the release of HAZE003

"6: SVT Swedish Television have never ever shown the film in its entirety

"7: SVT Swedish Television only filmed the first show

"8: It is impossible for Experience Hendrix LLC or their, lawyers to actually show any evidence to support their claim because it never happened.

"9: Purple Haze Records Ltd asked Experience Hendrix LLC and their lawyers to show evidence to support their fictitious claims prior to the release. The Stockholm concert HAZE003 that was a double show CD that was not possible to have been taken from SVT Swedish television film as is claimed. Experience Hendrix LLC refused to show any evidence to support their claim.

"10: Purple Haze Records Ltd told Experience Hendrix LLC we would not produce any further product if they would show evidence to support their fictitious claim prior to the release of HAZE003. Experience Hendrix LLC refused.

"11: Please note: Purple Haze Records Ltd is continuing with the legal action that is not yet over. Another false claim by Experience Hendrix LLC

"12: Purple Haze Records Ltd has reported Patrick Gardiner to the police and the law society for perjury and trying to pervert the course of justice.

"13: Purple Haze Records Ltd has reported Reed Wasson to the FBI for perjury, trying to pervert the course of justice and fraud."
